Guardian Paws — Terms & Conditions of Sale (Buyer-First)

This Puppy Purchase Agreement (“Agreement”) is between Guardian Paws, LLC (“Guardian Paws,” “we,” “us”) and the Customer (“you”). By reserving or purchasing a puppy (the “Puppy”) and any related products or services (the “Products/Services”), you agree to the terms below.

1) Our Promise & Scope

We connect families with responsibly raised, health-checked puppies from certified breeder partners. These Terms work together with our 10-Year Health Commitment (incorporated by reference). Where these Terms and the Health Commitment conflict, the interpretation most favorable to the Customer applies.

2) Transparency, Condition & Information

We provide accurate details (breed, DOB, weights, photos, registration) based on breeder and veterinary records. If any material error is discovered (e.g., wrong breed/sex/registration status), you may cancel for a full refund before delivery or accept a suitable remedy we offer (your choice).

3) Pricing & What’s Included

Your invoice shows the Puppy price and any optional add-ons (travel, health certificate, pup pack, etc.). We do not mark up veterinary certificates beyond our cost. Taxes are collected where required by law.

4) Customer-Friendly Cancellation & Delays

  • 24-Hour Grace Period: Cancel within 24 hours of payment → 100% refund.
  • Before Delivery Date Is Confirmed: Cancel anytime → full refund minus up to 5% payment processing (if our processor won’t refund fees).
  • After Delivery Date Is Confirmed:
    • More than 7 days before delivery: refund 90%.
    • Within 7 days of delivery: refund 75% (we’ve already committed transport & care).
  • Excessive Delays: If delivery is delayed more than 21 days beyond the original estimate for reasons outside your control, you may cancel for a full refund.
  • All refunds are issued via your original payment method unless otherwise agreed.

5) Travel & Delivery

We offer door-to-door, near-home delivery, or pickup near the breeder. All transport is handled by trusted, USDA-certified partners. Puppies must be travel-ready (generally ≥ 8 weeks and meet minimum weight/health criteria). We’ll keep you updated with an estimated delivery window and confirm details as soon as they’re set. If weather or safety requires changes, we’ll prioritize your puppy’s comfort and notify you promptly.

6) Health Standards & Nose-to-Tail Vet Exam

Every Puppy:

  • Is kept current on vaccinations and deworming per veterinarian-approved schedules.
  • Receives a nose-to-tail exam by a licensed veterinarian before delivery.
  • Is accompanied by a Veterinary Health Report (VHR) summary.

If a contagious illness or parasite is diagnosed by a licensed vet within 14 days of arrival, we will reimburse reasonable, customary veterinary treatment costs up to the Puppy’s purchase price (see Health Commitment for details). Keep all receipts and notify us within 48 hours of diagnosis.

7) 10-Year Health Commitment (Customer-Forward Summary)

  • Days 1–14: Reimbursement for treatment of contagious illness/parasites (reasonable & customary fees, up to purchase price).
  • Year 1: If a congenital/hereditary condition is diagnosed and impacts health, we reimburse documented deductibles/copays (with active pet insurance), or arrange a mutually agreeable remedy.
  • Years 2–10: If two licensed veterinarians certify a congenital/hereditary condition that adversely affects health, choose one:
    • Credit up to 50% of purchase price toward another Guardian Paws puppy, or
    • Direct reimbursement up to 25% of purchase price for documented veterinary expenses.
      Full terms are in our Health Commitment; ambiguous provisions are interpreted in favor of the Customer.

8) Satisfaction & Support

New environments can be stressful. Contact us first—we’ll help with transition tips, feeding plans, and vet readiness checklists. If a manageable issue arises within 7 days of arrival (non-medical), we’ll provide practical support (training resources, feeding adjustments, etc.). Our goal is a smooth, happy start.

9) Returns & Rehoming (Compassionate Policy)

We don’t resell returned puppies for profit. If you can no longer care for your Puppy at any time:

  • Contact us immediately. We’ll assist with ethical rehoming through our network.
  • Returns are accepted on a surrender (rehoming) basis without a monetary refund (unless required by law).
  • We can help coordinate transport at cost. The Puppy’s welfare comes first.

10) Registration Papers

If the Puppy is registrable, papers will be mailed after we receive spay/neuter confirmation (unless you purchased breeding rights explicitly). Typical timing: 2–8 weeks from confirmation (up to 6 months if the registry is delayed). Lost papers can be reissued at cost.

11) Customer Care & Code of Conduct (Friendly & Realistic)

We ask you to:

  • Provide a safe, indoor home; quality food & water; routine vet care; daily exercise and enrichment.
  • Schedule a welcome vet visit within a few days of arrival.
  • Keep ID tags or microchip info current.
  • Follow local laws and be a good neighbor (leash, licensing, waste disposal).
  • Spay/neuter at your vet’s recommended age, unless purchased with breeding rights.

12) Photos, Listings & Honest Mistakes

We strive for accuracy, but minor listing variances can occur. If a material discrepancy is found (e.g., sex, breed, registration), you may cancel pre-delivery for a full refund or accept a fair remedy we propose.

13) Dispute Resolution (No Mandatory Arbitration; Buyer-Friendly Venue)

We prefer to resolve concerns informally. If an issue arises:

  1. Email us with details and receipts. We’ll respond within 5 business days.
  2. If unresolved, you may choose:
    • Small Claims Court in your county/state, or
    • Voluntary arbitration under AAA Consumer Rules only if you elect it.
      No mandatory arbitration. No class-action waiver. Nothing here limits your rights under applicable consumer protection laws.

14) Choice of Law

These Terms are governed by the law of your U.S. state of residence at the time of purchase (or the province if in Canada), without regard to conflict-of-law rules.

15) Privacy & Communications (Opt-In Only)

  • We collect only what’s needed to complete your purchase and support your Puppy.
  • Text/phone/email marketing is opt-in only. You can unsubscribe anytime.

16) Warranties & What We Don’t Promise

Except as provided in our Health Commitment and required by law, we don’t guarantee adult size, exact weight, color changes, conformation titles, or specific temperament outcomes. Any implied warranties that cannot be disclaimed by law remain in full effect for your protection.

17) Force Majeure & Safety-First

Weather, airline restrictions, emergencies, or vet advice may require schedule changes. We’ll communicate promptly and prioritize your Puppy’s safety. If delays exceed 21 days beyond the original estimate, you may cancel for a full refund.

18) Severability

If any provision is found invalid, the rest remain enforceable. Invalid provisions will be replaced with terms that most closely reflect the original intent in a customer-friendly manner.

19) Entire Agreement

These Terms plus the Health Commitment and your invoice are the entire agreement regarding your purchase, superseding prior communications on these topics.
